These are the Terms and Conditions upon which Diff Technics Australia Pty Ltd - ACN: 132 930 226 / ABN: 42 132 930 226 (“Company”) sells and quotes for the supply of Goods and/or Services to another party (“Buyer”).
Diff Technics Australia Pty Ltd ACN: 132 930 226 / ABN: 42 139 930 226 is a wholesale/retailer of automotive driveline parts.
The website at www.difftechnics.com.au (the "Website") is a shopping website where you can browse, select and order products, advertised on the Website, from Diff Technics Australia Ltd.
In the context of the Website, and these terms and conditions, "we", "our" and "us" means Diff Technics Australia Pty Ltd and "you" and "your" means you, the user or customer of the Website, or the customer of Diff Techics Australia Pty Ltd.
The use of the term "goods” or “product" includes the plural "products" means all product or services provided by the Company.

“Third Party Product” means any non-Diff Technics manufactured Product, including Ancillary Parts, supplied to the Customer and having its own manufacturer’s warranty;
“Warranty Policy” means the document that details the Company’s warranty conditions in addition to any other rights and remedies available to the Customer under the law and can be found on the Company’s website
Except if otherwise required by law the following terms and conditions and our Privacy Statement and Policy, govern your use of the Website and/or the purchase of products from us. They describe the rights and responsibilities of both you and Diff Technics Australia Pty Ltd. If you use the Website, or purchase products from us, you agree to be bound by these terms and conditions.
If you do not agree to the terms and conditions, and our Privacy Policy, do not use the Website or purchase products from us.

The price displayed for products on the Website, or in any catalogue, represents the full price, including GST (Goods and Services Tax), for the product itself but does not include postage/delivery charges which will depend on the destination.
We always seek to provide products at the most competitive prices, and reserve the right to change prices displayed for products on our website at any time.
All of our prices are in Australian dollars (AUD)
Product prices are regularly updated when price changes are received from our suppliers. If you find a cheaper advertised price somewhere else, email us with the details of the product, price and supplier together and we will endeavour to provide you with a more competitive price.

Should we suffer any loss or damage as a result of a transaction entered into by a person under the age of 18, we reserve the right to seek compensation for such loss or damage from the parents or guardians of the person who placed the order(s) with us

ONLINE PURCHASING ACCOUNT

We retain sole discretion in relation to;

Incorrect information provided may lead to a delay in delivering the product ordered by you or non-delivery of the product. You are responsible for the confidentiality of your account password. ENTIRE AGREEMENT
These terms and conditions together with your order constitute the entire contract between you and us for the supply of products. No other terms will apply except where terms may be implied by law. The contract cannot be varied unless we agree to vary it in writing or by email.
ORDERING PRODUCT
When you place an order with us you have made an offer to purchase the product that you have chosen.
You can place an order, via the Website, by clicking the "Add to Cart" button.
When we issue a tax invoice to you, we have accepted your offer. Both the offer and acceptance are based on these terms and conditions.
We will issue you with an order number after we have received your offer to purchase.
We may notify you when we process your order by sending you an order confirmation and tax invoice. The order confirmation and tax invoice may be sent via email. In order to prevent credit card or payment fraud your offer can only be accepted by us after it has passed our validation procedures.
We retain discretion to cancel orders if our processes identify any attempt at fraud or for any other legitimate reason.
If for any reason we cannot process or accept your order after payment is received, we will contact you by email or telephone to determine your requirements for the reimbursement of money paid.
ORDERING A "PRE-ORDER" PRODUCT
These are products that are not available and/or are currently sold-out from our online shop.
Pre-order means placing orders in advance for these products, which requires a full payment from a client interested in procuring the said product.
Please make sure you have read and understood all the conditions written here before submitting your Pre-Orders.
PRE-ORDER POLICY
A full amount of payment is required on Pre-Order products listed on our website
Shipping (ETA) of Pre-Order products is specified on each products' product page on our website
Delays can occur resulting from circumstances beyond our control
Orders of Pre-Order products are considered final once payment is received

Pre-Order Process
At the time of purchase you were aware the product was a pre-order, there was a wait on the product and you agreed to the terms set out on this Website.
You have viewed the product online, have read carefully the product description and specifications and accept the product.
You are aware of the total costs.
The approximate lead times are specified on the product page on our website
PLEASE NOTE: If your order contains both in stock products as well as pre-order products, we will hold the order until the pre-order products arrive from our suppliers before shipping the full order to you. We recommend placing separate orders if you do not wish to wait for the in stock products.
Returns of Pre-Order products:
All pre-orders are classified as a custom order as we would not have ordered them if you had not purchased them, as such, these items are non-returnable. This does not exclude your rights under Australian Consumer Law (ACL) as you may still have warranties or guarantees on the products description, fit for purpose and quality. For more information on this please refer to the Australian Consumer Law rights of a consumer.
Cancellation of Pre-Order products:
All pre-orders are classified as custom orders and as such, if you choose to cancel your order, the customer will forfeit the full amount paid
Pre-order products lead time is specified on the product page on our website but could incur longer periods due to: Australian custom clearances, inclement weather, strikes and other issues that may arise which are out of our control.
By paying all of the order, the customer agrees to accept the Terms and Conditions set out in these Terms &Conditions
INTERNATIONAL ORDERS
We are currently not offering international shipping rates on our website. Contact Diff Technics with information on the products you are interested in, and we can send you quotes on Shipping Rates for your order.
International delivery times, and ETA, will be advised to you when we send you the quotation of the Shipping Rates.
PAYMENT TERMS
Goods will only be dispatched if:
- Full payment is received
- Funds have been transferred directly into Diff Technics Australia Pty Ltd account
- Credit Card payments accepted (1% surcharge applies)
We will not be responsible for any damages, consequential losses (whether direct or indirect) suffered by a customer whose credit card is fraudulently used or is used in an unauthorised manner.
Australian Customers
We accept payments through Direct Deposit/Bank Transfer, PayPal and Credit cards (Visa, Mastercard).
With Direct Deposit/Bank Deposit - orders will not be shipped until payment has been cleared and accepted.
International Customers
We only accept payments through Direct Deposit and PayPal.
Orders will not be shipped until payment has been cleared and accepted.
For International Shipping – Please note additional customs fees and duties may be applied upon delivery. You will be liable to pay your country’s applicable Import/Duty Taxes on receipt of your package.
If the buyer refuses to accept delivery as they do not want to pay the Customs Duty/Taxes, they then wear the cost of returning the order to us, and this includes the freight cost. These amounts will be deducted from their refund.

SHIPPING PRACTICES AND DELIVERY POLICY
Items purchased are shipped from our stock warehouse located in Kogarah, New South Wales. Our delivery partners are Fedex/TNT Couriers. If, for any reason, your order, or part thereof, cannot be shipped you will be notified promptly.
Orders are dispatched within 1-2 business days.
Diff Technics Australia Pty Ltd ships goods Australia wide and on a special request basis Internationally.
All parcels upon delivery will need to be signed for.
Under no circumstances will parcels be left unattended or without a signature from the receiver. (NO "ATL" Authority to Leave offered)
If you are not available, when our delivery partner attempts a delivery, a card may be left advising you that your order will be available for you to collect from your local post office. If no such arrangements can be made, we, or our delivery partner, will attempt to contact you to arrange an alternative delivery time.
Please Note: We DO NOT deliver to PO Boxes.
SHIPPING RESTRICTIONS
Some items are hazardous and shipping restrictions apply (for both Australian and International Orders). Should a shipping restriction apply, we will contact you. Alternatively, please contact our sales department, during business hours, to discuss any such restriction
For security reasons, we do not ship to post office boxes (for both Australian and International orders).
SHIPPING RATES AND HANDLING CHARGES
Please note that shipping and handling rates are calculated through the shipping calculator on checkout page, based upon your location and the size / weight of your order. Remote areas, pallet deliveries and bulky items may attract additional costs.
